São Paulo: what actually goes wrong

The setups that repeat in São Paulo, what the law here really says, and what to do if the police turn up. Plain, unhysterical, written for adults.

What goes wrong in São Paulo is almost always the journey, not the destination. A ride-hailing car that changes route, an address that becomes another address by message at the last minute, a building with no doorman on a street with no traffic. Agree the address and the hour in writing before either of you leaves, and treat a last-minute change as a reason to stop. The centre after midnight is a different city, and Cracolândia is a few blocks from streets that look calm.

The law where you are standing

Brazil has never criminalised selling sex, and there is no article of the Penal Code that does: an adult may be paid for it and the client commits no offence either. What the code does criminalise is everyone else. Articles 227 to 231 cover inducing, facilitating, keeping an establishment and profiting from another person's prostitution - so a brothel, a manager and a fixer are all illegal, and the letter of Article 229 is broad enough that two women sharing a flat to work have been prosecuted under it. The result is an entirely independent trade with no legal infrastructure around it. Sex with anyone under 18 is a serious crime prosecuted separately, and so is any form of coercion or trafficking.

Almost nothing here is exotic. The same four or five scripts run in every city in Europe, and the only reason they still work is that men who feel embarrassed do not compare notes.

Two adults in a private room is not, by itself, a police matter in most of Europe. Stay still, stay polite, do not run and do not volunteer a story. You are allowed to say you would prefer to speak with a lawyer. Do not sign a statement in a language you do not read.
